Documentary Film "These Changsha People" Is Censored

Indie documentary film "These Changsha People", produced
by Hunan intellectual Liu Yimu, had entered post-production
but before completion the relevant materials were confiscated
and deleted by the Domestic Security Division.
Initially, Liu wished to use the film to build a communication
bridge between officials and civilians, but he found
the gap between reality and his aspirations to be too distant.
Liu Yimu believes that every city is changing
and he wanted to record the changes.
People from all walks of life in Changsha
were interviewed for the film.
Liu says he wants to facilitate people's understanding
of the diverse array thinking from people in the city.

Judge in China rules against gay couple
(13 Apr 2016) A judge on Wednesday ruled against a gay couple in China's first same-sex marriage case seen as a landmark moment for the country's emerging LGBT rights movement.
The case attracted several hundred cheering supporters to the courthouse.
The court in the central city of Changsha dismissed the suit brought against the local civil affairs bureau for refusing to issue the couple a marriage registration certificate.
The couple's lawyer Shi Fulong said he expected the judge would rule against them but not so soon - within just a few hours.
Plaintiff Sun Wenlin said he would appeal until he exhausts all legal options.

Chinese Rights Lawyers Beaten and Detained for Visiting 'Black Jail'
Several prominent Chinese rights lawyers were beaten and detained as they tried to visit a "black jail" on Monday.
Li Heping, a rights lawyer from Beijing, told Radio Free Asia he was on the phone with one of the lawyers, Tang Tianhao, while security guards from the unofficial detention center attacked them. Li said the group also included rights lawyers Tang Jitian and Jiang Tianyong.
Li said the lawyers were trying to visit the Ziyang Municipal Legal Education Center in Ziyang City in southwest China's Sichuan Province.
The center was reportedly set up to detain followers of the spiritual group Falun Gong, which has been persecuted in China since 1999. Li said the center was holding several hundred people there illegally.

Video of detained activist Jiang Tianyong posted by Changsha police
Police in the central Chinese city of Changsha have denied claims that legal activist Jiang Tianyong has been tortured whilst in detention, and have released a video of Jiang walking.
Its claims were made before Jiang's wife Jin Bianling was due to testify at a US Congress hearing to "examine the torture, disappearances, and detention of human rights lawyers and democracy advocates in China,” on Thursday afternoon, Washington DC time.

China's First Ever Case on Same-sex Marriage Rights Heard
China's first ever case on same-sex marriage rights was heard in Changsha, the capital city of central China's Hunan Province on Wednesday.
The gay couple, Sun Wenlin and Hu Mingliang, sued the registry office at Changsha Furong District Civil Affairs Bureau for refusing to register their marriage, despite a lack of any stipulation that a marrying couple must be two people of opposite gender.
Over 200 people including local college student and LGBT people from around the country arrived at the court to support the couple.
The entire trial lasted for three hours and finally the court announced that the registry office has won the case.

On August 11, Xie Yang, a lawyer who was arrested and tortured in the 709 crackdown—a nationwide crackdown on Chinese lawyers and human rights activists in 2015—had his lawyer’s license revoked illegally by Hunan Provincial Department of Justice. On August 15, Hunan Lawyer Association also cancelled his membership. At the same time, Xie Yang received threats and intimidation from the local authorities, demanding him not to defend sensitive cases and accept interviews from overseas media. He was threatened with more severe criminal charges if he did not abide by the rules.
Since Xie Yang started to work as a lawyer in 2011, he represented a large number of human rights cases and Falun Gong cases, and was also concerned about human rights campaigns. He was suppressed by the government because of this. He was arrested on July 11 during the 709 crackdown.
In January 2017, Xie Yang’s defense attorney, Chen Jiangang, published a “Transcript of the meeting with Xie Yang” disclosing the torture Xie received during his detention. In May of the same year, Xie Yang was bailed out. On December 26, 2017, Xie Yang was formally sentenced by the Changsha People’s Intermediate Court for the so-called "crime of inciting subversion of state power" and was exempted from criminal punishment.
Xie Yang continued saying: “After I got out, I represented many cases that they believe are sensitive. They have also threatened and intimidated me through various means not to represent any more cases and not to accept interviews from foreign media during the process of handling the case. Through various means, they said that if I continued to expose their illegal and criminal actions, they would press more severe criminal charges against me.”
Xie Yang believes that in the past, the CCP was more afraid to cross the line because the international community, the United Nation, and foreign media were highly concerned about the suppression of human rights lawyers in China. But since the current relations between China and the U.S. and other western countries are tense, the CCP does not care as much about the solidarity he received from international human rights organizations, so he's expecting to suffer more.

Indie documentary film "These Changsha People", produced
by Hunan intellectual Liu Yimu, had entered post-production
but before completion the relevant materials were confiscated
and deleted by the Domestic Security Division.
Initially, Liu wished to use the film to build a communication
bridge between officials and civilians, but he found
the gap between reality and his aspirations to be too distant.
Liu Yimu believes that every city is changing
and he wanted to record the changes.
People from all walks of life in Changsha
were interviewed for the film.
Liu says he wants to facilitate people's understanding
of the diverse array thinking from people in the city.
He wants his film to reflect the many different thoughts
and ideas so that the people and the government are informed
and a door to collaboration between the two groups
can be opened.
Liu Yimu: "This is so that people can come to know the wide
range of ideas in this city.
This diversity need to be valued.
In addition, it allows us to understand each other in this city
and know what other people are thinking."
Cheng Qiubo, production staff of "These Changsha
People": "In the area of documentary films, the state media
uses one model and one voice.
We want to view from an objective angle,
to watch and record the true society."
Filming for "These Changsha People" began on Jan. 3.
23 people from different professions with different
political ideas were documented.
University professors, students, entrepreneurs,
lawyers, fashion models, and petitioners were featured.
The film also included senior pro-democracy activists
and retired soldiers.
Cheng Qiubo said that a lot of thought was put into recording
thoughts and moments in the lives of Changsha people.
The producers feared suppression by the regime, thus they
decided not to include anything that would be deemed
too sensitive in the film; they took a neutral stance.
However, Cheng pointed out that the film involved several
people who were being monitored by officers
of the Domestic Security Division, including one senior
pro-democracy activist, 79-year-old Zhang Jingsheng
whose daily spending is less than 10 yuan ($1.65),
as well as a retired teacher Tong Shidong, age 80,
who was a pro-democracy activist
in the Tiananmen Student Protest of 1989.
Tong, who had been jailed for nine years,
currently lives a very hard life alone.
Liu Yimu did not expect that from Jan. 7, the film crew
would become the target of the Domestic Security Divison.
Liu Yimu: "They suddenly told me on Jan. 11 that their
leaders are very concerned about this issue and gave the order
to cease production on the film.
I asked them who their leaders are, they didn't tell me."
At the time, Liu thought that officers of Domestic Security
Division collecting information to find out what people
are thinking may not be a bad thing.
However, Liu didn't expect that any content of his film
would be deleted except one professor's interview.
Liu says that the Domestic Security Division
breached their agreement.
He and other partners of the film will request the regime
to publicly disclose their findings on this incident.
They plan to ask the regime to return the materials
that are not seen as sensitive.
Liu Yimu: "They have no reason to intervene.
They created terror and threats -- if we carry on,
they will throw us into prison."
Liu points out that in China, everyone has faced
political threats and when the spy agent tells you they would
"make you disappear", you really would be disappear.
Liang Taiping, production member of "These Changsha
People": "They confiscated our materials without legal
procedure, we will maintain our rights and protest."
Liang Taiping believes that the regime fears people having
different thoughts and different voices.
Liu Yimu says that he will make efforts to finish the film.
Since 2012, several shocking cases took place in Hunan.
including activist Li Wangyang's death, petition-mother
Tang Hu's detention and real estate businessman
Zeng Chengjie's secret execution.
All of these incidents have caused
a huge amount of controversy.
Recently, Hunan regime strengthened its suppression
of dissidents including stopping Luo Liang and Chen Junxian
from leaving the country at the airport.
Pro-democracy activist Ouyang Jinghua was denied
an application for entry into Hong Kong and Macau.
Citizen Ou Hufeng was prevented from leaving
the country in Luohu, Shenzhen.
Cheng Qiubo who is currently in Los Angeles says that
since mid 2013, the effort that Hunan regime has put into
stability maintainance, is more than any other city.
Hunan also intensified the suppression of freedom
of publication and persecution of dissidents.
Meanwhile the regime's behaviors have increasingly
aroused public anger.

(13 Apr 2016) A judge on Wednesday ruled against a gay couple in China's first same-sex marriage case seen as a landmark moment for the country's emerging LGBT rights movement.
The case attracted several hundred cheering supporters to the courthouse.
The court in the central city of Changsha dismissed the suit brought against the local civil affairs bureau for refusing to issue the couple a marriage registration certificate.
The couple's lawyer Shi Fulong said he expected the judge would rule against them but not so soon - within just a few hours.
Plaintiff Sun Wenlin said he would appeal until he exhausts all legal options.
The lawsuit comes amid growing awareness of lesbian, gay, bisexual and transgender issues in China, where society and the government have generally frowned on non-traditional expressions of gender and sexuality.
China doesn't legally recognise same-sex marriage and officials with the central government have said they do not see the law changing soon.
While homosexuality is not illegal in China, the country's LGBT movement is still in its infancy and it is rare for same-sex couples to live openly.

Several prominent Chinese rights lawyers were beaten and detained as they tried to visit a "black jail" on Monday.
Li Heping, a rights lawyer from Beijing, told Radio Free Asia he was on the phone with one of the lawyers, Tang Tianhao, while security guards from the unofficial detention center attacked them. Li said the group also included rights lawyers Tang Jitian and Jiang Tianyong.
Li said the lawyers were trying to visit the Ziyang Municipal Legal Education Center in Ziyang City in southwest China's Sichuan Province.
The center was reportedly set up to detain followers of the spiritual group Falun Gong, which has been persecuted in China since 1999. Li said the center was holding several hundred people there illegally.
Li Fangping, another rights lawyer from Beijing, said lawyers in China have been attacked and beaten by authorities more frequently.
In the past two years, Chinese lawyers have been banned from representing certain clients and risk prosecution for subversion for defending sensitive cases.

China's first ever case on same-sex marriage rights was heard in Changsha, the capital city of central China's Hunan Province on Wednesday.
The gay couple, Sun Wenlin and Hu Mingliang, sued the registry office at Changsha Furong District Civil Affairs Bureau for refusing to register their marriage, despite a lack of any stipulation that a marrying couple must be two people of opposite gender.
Over 200 people including local college student and LGBT people from around the country arrived at the court to support the couple.
The entire trial lasted for three hours and finally the court announced that the registry office has won the case.
"I feel disappointed. China's Marriage Law currently states that marriage is strictly between a man and woman. But I reiterated on the court that the law doesn't explicitly forbid same-sex marriage, it is open to interpretation. But the final judgment ignored that," said Sun.
Sun met his boyfriend Hu in 2014 and on June 23 in 2015, the couple decided to get married and went to the local registry office in Changsha, but the official there refused to issue a marriage license to them, insisting only heterosexual couples could marry.
Sun then sued the registry office for deny their application to marry in December 2015. He and Hu have become the first gay couple in China to legally fight for their right to marry.
After the trail, their lawyer Shi Fulong said: "Although we didn't get what we desired, the applause from the audience proved what is right."
People audited the trail expressed their views toward the case.
"My good friend is a lesbian, but she and her female partner never thought of coming this far like Sun and Hu. I think they are brave. So today I came here to see the country and government's attitude towards these people, and their reasons to reject them,” said a local resident.
Another local resident said: "I don't feel disappointed after hearing they lost the case. I believe that same-sex marriage will be legalized in the future. The country will treat us like anyone else."
"It's like a long march," a resident commented, "This is the first step. A good step. I believe it will get better and better. Maybe in five or ten years, we will witness the day."
Sun said he would keep appealing.

Another local resident said: "I don't feel disappointed after hearing they lost the case. I believe that same-sex marriage will be legalized in the future. The country will treat us like anyone else."
"It's like a long march," a resident commented, "This is the first step. A good step. I believe it will get better and better. Maybe in five or ten years, we will witness the day."
